Federal judge denies motion for state to enforce new abortion restrictions

TUCSON (KVOA) - A federal judge announced Tuesday that they will not let the state enforce new abortion restrictions. 

In September, a judge blocked a key part of a new abortion law. 

That provision would have made it a class 6 felony to perform an abortion solely because of a genetic abnormality such as down syndrome.

In her ruling, Judge Douglas Rayes said that this portion of the law "imposes an undue burden on the rights of a woman." 

Arizona Attorney General Mark Brnovich then filed a motion to allow the state to enforce those restrictions while the courts considered an appeal, however on Tuesday, a judge denied that motion.
