Posted 4:40 PM 10/15/2012 : Teen shot 8 times by border agent in Nogales, attorney says
NOGALES, Ariz. - An attorney for the family of the 16-year-old who died after being shot by a Border Patrol agent last week said the boy was hit eight times.
Luis Parra is representing the family of Jose Antonio Elena Rodriguez. On Monday, Parra described what was concluded in Rodriguez's death certificate: "he was shot approximately eight times. He had six shots that were the cause of death; two through his head and four punctured his lungs."
The shooting happened late Wednesday night along the border in Nogales. The Border Patrol released a statement saying an agent discharged his firearm after being assaulted with rocks. Rodriguez was walking along a sidewalk in Mexico just a few yards south of the border when he was shot, Parra said. According to Parra, a doctor's office also sustained gunfire in the shooting. He said Rodriguez did not have a criminal history and there are no indications he was involved in illicit activities.
He and attorney Roberto Montiel are representing Rodriguez's family. Parra described Rodriguez as being very involved in his church, adding, "His neighbors and his schoolmates have told us that he was just a very good young man."
Parra said the boy's death has international ramifications in the United States and Mexico, "the people of Ambos Nogales deserve a transparent, thorough investigation and of course, they're going to be seeking justice."
Parra said Rodriguez is survived by his mother, older brother, two younger sisters and grandmother. The family told Parra that Rodriguez had hopes of joining the Mexican military one day. Funeral services were held Sunday in Nogales, Sonora.
Neither the FBI or the U.S. Border Patrol would provide a comment, as the investigation is still ongoing at this time.
