Tombstone man identified as suspect in shootout with BP agents

A Tombstone man has been identified as the man involved in a shootout with Border Patrol agents near Tombstone on Wednesday, according to U.S. Customs and Border Protection. 

Gary Smith, 76, drove his 2008 Dodge Dakota into traffic barricades at the State Route 80 immigration checkpoint at State Route 80 and State Route 82 north of Tombstone. The checkpoint was closed because of weather.

As Smith crashed his truck through the barricades, he was shooting out the windows at BP agents, according to officials.

The agents returned fire, hitting Smith in the left arm and stopping the assault.

Smith was flown via helicopter to an undisclosed Tucson area hospital. He is in custody and is recovering from a non-life threatening injury.

According to the Associated Press, authorities said his daughter had earlier called 911 saying that her father had driven off, had medical issues and had guns and alcohol with him.

There were no other injuries.

 The immigration checkpoint has re-opened.
