TUCSON-Reporters from around the country called University of Arizona Law Professor Jack Chin to explain Judge Bolton's ruling on S.B. 1070.
Chin says, "Opponents will be thrilled. The heart of the law was enjoined. The most important provisions of the law were held invalid."
The ruling came in the Justice Department's case United States versus Arizona.
Chin says, "This is a clear win for the United States. They won on basically every important point that they argued."
Chin explained the judge's ruling. He says, "She said that the parts of the law that she said were invalid were federally preempted. Basically what this decision means is,
as the Supreme Court has held for almost 150 years, that regulation of immigration is primarily a federal responsibility and not a state responsibility."
Judge Bolton did not throw out all of 1070. Chin says remaining parts will take effect.
But asked, "What new happens at midnight tonight?" Chin says, "Not much, not much."
But Chin believes this court fight isn't over. He says, "The law permits an immediate appeal of the grant or denial of a preliminary injunction to the Court of Appeals."
