TUCSON - A Tucson family taking steps to sue the Catalina Foothills School District.
The complaint alleges negligence. They accuse a staff member of withholding water, and forcing a girl to exercise in extreme summer heat.
The complaint says the girl was forced to run a mile to the Safeway and back with no water breaks. It was 107 that day.
Court paperwork shows during an after school activity a staff member told a group of girls that running would "toughen them up".
The complaint says parents observed two students dropping to the ground and vomiting.
The staff member then allegedly said to one girl, that it was good for her, because she could get rid of the "bile" in her stomach.
The complaint says two other students helped the girl back to school. A student called the girl's mother to come pick her up.
Officials with Catalina Foothills Unified School District were unaware of the complaint, filed August 10 in Superior Court.
District Superintendent Dr. Mary Kamerzell tells News 4, "if a lawsuit was filed, we haven't seen it. If it exists, we have not been served. We don't comment on litigation and certainly not if an employee's reputation is on the line."
Paperwork states the girl suffered permanent injuries. Chronic migraine headaches that require medication and doctor visits.
They also claim emotional distress, and humiliation.
So far, the family has not returned our request for an on-camera interview.
News 4 also reached out to the staff member mentioned in the complaint, by our 10pm newscast deadline we had received no response.
