TUCSON - Pima County Sheriff's officials are now saying that the man shot to death while being served a warrant last week did not fire at deputies, but did point an assault rifle at them.
Jose Guerena, 26, was being served a search warrant by the Pima Regional SWAT Team at the 7100 block of S. Redwater Dr., when he pointed a military-style AR-15 assault rifle at them, PCSO officials say. The rifle had the safety on, contained one round in the chamber and additional rounds in the magazine. SWAT members fired at Guerena, striking him, and he was pronounced dead at the scene.
Initial report indicated that Guerena had fired his gun at deputies, but further investigation revealed he did not fire his weapon, PCSO officials say.
Guerena's wife and 4-year-old son were in the residence at the time of the incident, but were not injured.
PCSO says the investigation continues.
