TUCSON - A Mexican man who was apprehended at the border and found to have been convicted in 1990 for lewd acts against a child has been sentenced to nearly three years in prison.
Marcial Avilar-Perez, 53, was apprehended by Tucson Station Border Patrol agents in September 2011, according to a news release from Customs and Border Protection. A fingerprint scan revealed that he was convicted in 1990 for lewd acts against a child under 14 years in Riverside County, California. He was sentenced to one year in jail.
On February 1, Avilar-Perez was sentenced to 33 months of confinement for attempting to illegally re-enter the United States as a felon, the release states. Following his incarceration, he will be formally removed from the country and banned for life from all legalization processes.
