PHOENIX (AP) - A federal appeals court has ordered a trial court to consider again whether an Arizona death-row inmate's sentence should be overturned because of his claims that he received ineffective legal representation.
A trial judge had ruled that David Scott Detrich's claims couldn't be considered, but the 9th U.S. Circuit Court of Appeals' ruling Tuesday says the U.S. Supreme Court changed the legal standard earlier this year.
Detrich was convicted in the 1989 rape and murder of Elizabeth Souter of Tucson. Her body was dumped in the desert.
