TUCSON- New information about what may have happened in the hours before a hit and run accident that killed a Sun Tran bus driver. News 4 Tucson has obtained court documents related to John Akers' death on May 23.
Enrique Hernandez is now charged with second degree murder and leaving the scene of an accident. The 24 year old made his first court appearance Wednesday night. Investigators say he hit 64-year-old John Akers at Irvington and Mission while Akers was biking to work. From the beginning, investigators told News 4 that alcohol may have been involved. Deputies even took another person into custody on a DUI warrant shortly after it happened.
A Statement of Probable Cause, obtained by News 4, says Hernandez denied driving at the time of the fatal collision, but that, "During one of the 3 blood draws Mr. Hernandez stated, 'this is the biggest mistake of my life. I'm going away a long time for this.'"
The investigation also found Hernandez and his cousin were drinking at a bar near Valencia and Cardinal and that they stopped at a nearby residence before separating for the night. Investigators say cell phone records place Hernandez in the area of the accident and trace his path toward the Northwest side where he was later found.
News 4 Tucson requested to speak with Hernandez, who is currently behind bars, to get his side of the story, but those calls have not been returned.
