Alleged victim of sexual misconduct speaks out

TUCSON - 30-year-old Aaron Montoya was arrested on June 25th, accused of having an inappropriate relationship with a 14-year-old girl. Montoya was a teacher and athletic director at Allsport Academy, the girl was a student there.

With her father's support, the 14-year-old shared her story only with News4. A former Allsport student also spoke to KVOA.

"There was no door on the girls bathroom. Meaning our teachers would just look inside the bathroom and say, 'let's go.' And we could be in the bathroom changing and they wouldn't knock on the side of the wall or anything," the former Allsport student said.

Neither 14-year-old wants to share her identity. They say their privacy has already been violated.

But for one of these girls, eighth grade at Allsport also meant the beginning and end of an inappropriate relationship with a teacher, Aaron Montoya.

"It was uncomfortable because it was like okay, I guess he is my friend but he's an older friend so it just made it weird," the alleged victim said. "I found him attractive," she said.

It all started, she says, with friendly text messages. Over seven months time, it turned into something more.

"One day we went to the movies, a new movie just came out so it was late, it was like 12:30 at night or 1 in the morning," she said. "He put his hand on my leg and, just, you know, gently started rubbing."

She says the two did have sexual intercourse more than once.

"I don't want to say it was, that it felt okay to me because I knew it was wrong, and I guess just the feeling of being wanted just kind of overpowered me just like knowing my rights and wrongs," she said.

Aaron Montoya's father, Moses Montoya, is the director of Allsport Academy. He says the school heard about the text messaging in April, and at the time, told both Aaron and the 14-year-old it all had to stop.

Once the school found out it had escalated to something sexual, Aaron was fired.

Allsport holds Aaron responsible.

As for the bathrooms, there are no doors leading into the restrooms at Allsport Academy. The school says it prevents drug in the building, and the state approves of the building's setup. In response to accusations of teachers looking in the girls bathrooms at the school, the director says if it happened, it was only to protect the students.

Still, both girls have decided to start 9th grade elsewhere.

Aaron Montoya is being held in Pima County Jail, facing three counts of sexual misconduct with a minor. His bond is set at $50 thousand. News4 tried to contact him regarding these allegations. He and his attorney declined comment.
